Terms of Service
Please read these Terms of Service carefully before accessing or using SHIFT7 software products. These include 1173, 119, Radar, RegTrax, and Five Questions. These terms apply to each product when you use it. By registering for, accessing, or using SHIFT7, you agree to be bound by these terms, including the disclaimers and limitations of liability set out below.
How we handle personal and firm information is set out in our Privacy Policy. In short: we only use that information to help you use SHIFT7 products, and we do not sell it or share it for advertising.
Effective Date: October 5, 2026
Software Only; No Professional Advice
SHIFT7 provides software tools, including regulatory update tracking through RegTrax and API RP 1173 contractor-topic, maturity, and gap tooling through 1173. SHIFT7 is a software technology provider.
SHIFT7 also provides these tools:
- 119: A tool for running process safety management audits and issuing reports. 119 does not replace the auditor's judgment. Best practice questions are scored on their own and are not part of the OSHA score.
- Radar: A client book that suggests who to contact and drafts messages, using RegTrax notices. You review and send every message yourself. SHIFT7 never sends anything for you.
- Five Questions: A short guide for checking a job before work continues. Five Questions does not authorize work. It is not a permit. It does not replace your site's procedures, permits, or the judgment of the people doing the work.
SHIFT7 does not provide legal, regulatory, engineering, environmental, or professional safety consulting advice. Information aggregated through RegTrax from publicly available EPA, OSHA, PHMSA, and FERC sources is offered for informational purposes. Use of SHIFT7 tools, maturity or gap outputs, and any generated reports does not constitute legal counsel or formal regulatory certification.
No Affiliation With the American Petroleum Institute (API)
SHIFT7 is an independent software provider and is not affiliated with, endorsed by, sponsored by, or officially associated with the American Petroleum Institute (API), or any of its subsidiaries or affiliates.
References to API RP 1173 and related terminology are used for descriptive and reference purposes to indicate the framework the software addresses. "API" and "American Petroleum Institute" are trademarks of their respective owners.
Fictional Examples and Demo Identifiers
Any company names, personal names, job titles, locations, and other identifiers that appear as examples, demonstrations, screenshots, sample data, or other illustrative content on the SHIFT7 website or in SHIFT7 product interfaces are fictional unless SHIFT7 expressly states otherwise. They are used solely for demonstration and explanatory purposes.
Such names and identifiers are not intended to refer to, identify, describe, or imply any affiliation, endorsement, sponsorship, partnership, or other relationship with any real company, organization, or person. Any resemblance to actual companies, organizations, or persons, living or dead, is coincidental.
Disclaimer of Warranties
To the maximum extent permitted under applicable law, SHIFT7 software, RegTrax, 1173, 119, Radar, Five Questions, related calculations, and exported materials are provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind.
RegTrax aggregates publicly available information from third-party government sources. SHIFT7 does not warrant the accuracy, timeliness, completeness, or availability of third-party agency records. SHIFT7 disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, SHIFT7 and its officers, directors, employees, partners, agents, and suppliers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of, or inability to use, SHIFT7 or any SHIFT7 product, including RegTrax, 1173, 119, Radar, and Five Questions.
This limitation applies to claims involving, without limitation:
- Inaccuracies, delays, omissions, or errors in RegTrax regulatory information.
- Lost business opportunities, missed bids, or unearned revenue related to use of SHIFT7 or RegTrax.
- Failures, rejections, or disqualifications during third-party operator audits or pre-qualification reviews.
- Regulatory fines, penalties, sanctions, or enforcement actions.
- Outages or interruptions, site incidents, injuries, property damage, or safety events.
In any event, the total aggregate liability of SHIFT7 for all claims arising under or related to these terms shall be capped at the total amount actually paid by your organization to SHIFT7 for access to the service during the 12 months immediately preceding the event giving rise to liability, or $100.00 USD, whichever is less.
User Responsibility
You acknowledge that business decisions, client communications, compliance filings, policies, evidence documents, and audit responses executed or uploaded using SHIFT7 or RegTrax are the sole responsibility of your organization and authorized users.
SHIFT7 does not verify or warrant the truthfulness or legality of user-uploaded documentation or of decisions made using RegTrax information. You are responsible for independent verification before taking commercial or operational actions.
This includes messages you send from Radar drafts, audit answers and reports you issue in 119, and calls you make at a job site with Five Questions. You are also responsible for what you type into job descriptions and notes.
No Guarantee of Commercial or Qualification Outcomes
SHIFT7 does not guarantee that your organization will win contracts, secure new clients, or pass third-party operator qualifications. Contract awards and vendor qualifications remain at the discretion of clients, pipeline operators, and regulatory agencies.
Indemnification
You agree to defend, indemnify, and hold harmless SHIFT7 and its affiliates, directors, officers, employees, and agents from and against claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of:
- Your organization's use or misuse of SHIFT7 products, including RegTrax data, 1173 tools, 119, Radar, and Five Questions.
- Any breach of these Terms of Service by your users.
- Commercial outreach or claims initiated using RegTrax information.
- Inaccuracies or misrepresentations in compliance documents, audits, or training records submitted to third parties.
- Safety incidents, regulatory violations, or operational accidents at your work sites.
Intellectual Property
SHIFT7 retains all rights, title, and interest in and to SHIFT7, including the software, aggregation pipelines, database schemas, scoring and gap tooling, user interface designs, logos, and documentation. These terms do not grant you ownership of SHIFT7 intellectual property.
Your organization retains ownership of proprietary policies, procedures, records, and customer data you upload or enter into your isolated organization environment.
Governing Law and Binding Arbitration
These terms shall be governed by and construed in accordance with the laws of the United States and the State of jurisdiction where SHIFT7 operates, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these terms shall be resolved exclusively through final and binding arbitration rather than in court. You agree to waive any right to participate in class actions or class-wide arbitration against SHIFT7.
Linked Documents from Third-Party Cloud Storage
SHIFT7 may allow you to link to documents stored in third-party cloud storage services you already use, including Google Drive and OneDrive. SHIFT7 does not claim ownership of those third-party services and is not affiliated with, endorsed by, or sponsored by Google LLC, Microsoft Corporation, or their affiliates.
You are solely responsible for:
- the permissions and sharing settings on any linked document;
- ensuring that only authorized users can access linked content;
- the accuracy, legality, and retention of documents stored outside SHIFT7.
Linked documents remain subject to the terms and privacy policies of the third-party storage provider. SHIFT7 provides linking as a convenience and does not warrant the availability, integrity, or security of third-party storage services.
